Welcome to PocketPro! These Terms of Service ("Terms") govern your use of the PocketPro mobile application (the "Service") operated by PocketPro ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PocketPro, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

PocketPro is an AI-powered golf application that:

  • Tracks your golf shots using GPS
  • Learns your personal distances and miss patterns
  • Provides club and aim recommendations based on your game
  • Offers course strategy and risk/reward analysis
  • Tracks your performance and ability rating over time
  • Enables social features to connect with other golfers

3. Account Registration

3.1 Account Creation

To use PocketPro, you must create an account using a valid email/password combination or Sign in with Apple (where available). You must be at least 13 years old to create an account.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Impersonate another person or entity
  • Harvest or collect user information without consent
  • Use the Service to harass, abuse, or harm others
  • Reverse engineer or attempt to extract the source code
  • Use automated systems or bots to access the Service
  • Share your account with others

5. Golf and Course Usage

5.1 Recommendations Are Advisory

PocketPro's club recommendations, aim suggestions, and strategy advice are based on statistical analysis of your past performance and are provided for informational purposes only. You are solely responsible for your shot decisions on the course.

5.2 Tournament Play

Some PocketPro features may not be permitted under USGA/R&A rules for tournament play. It is your responsibility to:

  • Check local rules before using PocketPro in competition
  • Understand which features are permitted under the applicable rules
  • Disable or avoid prohibited features during tournament rounds

Distance measuring devices are generally permitted, but features providing aim recommendations or club selection may not be allowed in all competitions.

5.3 Course Data

Course information is provided through third-party data sources. While we strive for accuracy, we do not guarantee that course layouts, yardages, or hazard positions are completely accurate or up-to-date.

5.4 Location Permissions

PocketPro depends on location services for shot tracking and distance features. By enabling location permissions, you allow us to process location updates while using the app and, if you grant background location access, during active round tracking in the background. You can change permissions in your device settings, but some features may not work correctly without location access.

6. Beta Program

If you are participating in the PocketPro beta program:

  • The Service may contain bugs, errors, or incomplete features
  • Features may change or be removed without notice
  • Your feedback may be used to improve the Service
  • We may terminate beta access at any time
  • Beta participation does not guarantee access to future versions

7. Intellectual Property

7.1 Our Rights

PocketPro and its content, features, and functionality are owned by PocketPro and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

7.2 Your Content

You retain ownership of data you input into PocketPro (including profile information, shot/round data, social content, and AI prompts). By using the Service, you grant us a license to use this data to:

  • Provide and improve the Service
  • Generate personalized recommendations
  • Create aggregated, anonymized analytics

8. Privacy

Your use of PocketPro is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

9. Third-Party Services

PocketPro uses third-party services including:

  • Supabase for data storage and authentication
  • OpenAI for AI-powered features
  • OpenWeather for weather data lookups
  • Third-party golf/course data providers for golf/course data APIs (which may receive course search parameters and/or location coordinates)
  • Apple services (including TestFlight and Sign in with Apple)

Your use of these third-party services is subject to their respective terms and privacy policies.

10. Disclaimers

10.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee of Results

We do not guarantee that using PocketPro will improve your golf game, lower your scores, or achieve any particular outcome. Results depend on many factors outside our control.

10.3 Service Availability

We do not guarantee uninterrupted or error-free service. The Service may be unavailable due to maintenance, updates, or factors beyond our control.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETPRO SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Any damages arising from your use of or inability to use the Service
  • Any conduct or content of any third party on the Service

Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless PocketPro, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

13. Termination

13.1 By You

You may stop using the Service at any time. To delete your account, contact us at info@pocketpro.golf.

13.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" and, where appropriate, through in-app notifications. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.

16. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@pocketpro.golf. We will attempt to resolve the dispute within 30 days.

17. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and PocketPro regarding the Service.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
